Attorney fees can be awarded against the spouse that is the higher earner spouse.  California law has long been that a court has the power to order the payment of fees and costs between the parties, based on their relative circumstances which include their income, needs and ability to pay.  This rule exists to make sure that a lower earner spouse’s rights are protected and he or she can seek a lawyer even though he or she cannot afford to pay one.
